INTRODUCTION
Welcome to the terms and conditions (“User Terms“) applicable to Plus Ecosystem Ventures Proprietary Limited (Registration No. 2022/321528/07) t/a Home+ (“Home+”, “we”, “us”, “our”). These User Terms apply when you:
- visit and/or use our website homeplus.africa (“Website“) and/or our mobile application (“Application”);
- use any of our services, including where you request the provision services from our third party suppliers (“Suppliers“) via our Website or Application (“Services”);
- interact with us or when we provide you with any information, recommendations and/or ancillary services.
PLEASE READ THESE USER TERMS CAREFULLY BEFORE DOWNLOADING OUR APPLICATION, ACCESSING OUR WEBSITE AND/OR USING OUR SERVICES. IF YOU DO NOT ACCEPT THESE USER TERMS, YOU MUST NOT USE THE SERVICES.
DEFINITIONS
For the purpose of these User Terms, the following definitions apply:
- “Collective Content” means, collectively, Home+ Content and User Content.
- “Content” means all content featured or displayed, including, but not limited to, logos, icons, trademarks, text, graphics text, graphics, photographs, images, moving images, sound, illustrations, music, software, opinions, remarks, comments, artwork, links, questions, suggestions, information or other materials.
- “Home+ Content” means Content owned or used by Home+, its affiliates or licensors and made available through the Website, Service or Application, including any Content licensed from a third party, but excluding User Content.
- “User” means a person who accesses or uses the Services.
- “User Content” means Content that a User posts, uploads, publishes, submits or transmits to be made available on the Website, Application or through the Services.
WHAT SERVICES DOES HOME+ PROVIDE?
Home+ has developed on-demand software which enables it to deploy (and track) tradespeople (Suppliers) to a User’s chosen location, to render Services to the User.
HOW IS AN AGREEMENT CONCLUDED BETWEEN HOME+ AND YOU?
By using our Services, you are contracting with us for the provision of the relevant Services (the “Agreement“).
In order to request the provision of Services from a Supplier, you first need to create an account with Home+. When creating an account, you will need to provide us with certain personal information, including, amongst other things, your name, address, identity number, mobile number and credit card information. Once you have successfully signed up with Home+, we will provide you with a personal account, accessible only with a password (of your choice).
You have to be at least 18 years of age to use the Services.
If you are using the Services as an individual, you represent that you are of legal age and otherwise legally competent to enter into a binding contract.
If you are using the Services on behalf of a legal entity, you represent that you are duly authorized to bind the entity to these User Terms and to use the Services as a representative of that entity.
HOW TO USE THE SERVICE AND THE APPLICATION
The Application and the Website allow you to request the provision of Services from a Supplier.
The Website and the Application both require internet connectivity, and the Application must be downloaded and installed by a User on a mobile device (for example, a smart phone or tablet) for it to be used.
The GPS receiver (installed on your device) detects your location and sends your location information to the relevant Supplier. Please note that we also receive and have access to this location data.
Suppliers have sole and complete discretion to accept or reject each request for the provisions of Services. Suppliers also have sole and complete discretion over whether to use the Application to receive the leads generated through the Application.
We will use reasonable efforts to bring you into contact with a Supplier in order to obtain the Services, but make no guarantees. The provision of the Services is subject to the availability of Suppliers in or around your location.
If a Supplier accepts a request, you will be notified and will be provided with certain information regarding the Supplier – including its name, company name (where applicable), and customer service rating. You will be able to contact the Supplier by telephone. The Application also allows you to track the Supplier’s progress towards the selected location, in real time.
Please note that Home+ is separate from the Suppliers. By using a Supplier who is offering Services through the Website or Application, you understand agree that such Supplier is an independent contractor. Suppliers do not have any employment relationship with Home+. The fact that such Suppliers market Services through the Website or the Application does not in any way create, establish or set up any agency, partnership or employment relationship between us and such Supplier.
We are merely the platform which connects Users to Suppliers and act only as intermediary between Users and Suppliers. We offer information and a method to schedule and obtain the Services advertised on our Website and Application.
The provision of Services by a Supplier to you is subject to the agreement (to be) entered into between you and the Supplier. Home+ shall never be a party to such agreement. You must ensure that you comply with your obligations in terms of any contract you have with a Supplier.
We run background checks on Suppliers, however, we do not guarantee or warrant, and make no representations regarding, the reliability, quality or suitability of such Suppliers. When interacting with a Supplier, you must exercise caution and common sense to protect your personal safety and property, just as you would when interacting with any other person whom you didn’t know. By using the Services, you agree to hold us free from responsibility for any liability or damage that might arise out of the transaction with a Supplier. Neither us nor our affiliates or licensors are responsible for the conduct, whether online or offline, of any User. Home+ and its affiliates and licensors will not be liable for any claim, injury or damage arising in connection with your use of the Services.
YOUR USE OF THE SERVICES
You warrant that the information you provide to Home+ (and a Supplier) is accurate and complete in all respects. Home+ is entitled at any time to verify the information that you have provided and, if any information is inaccurate or incomplete, to refuse the Services without providing reasons.
You may only access the Services using authorised means. It is your responsibility to check to ensure you download the correct Application for your device. Home+ is not liable if you do not have a compatible device or if you download the wrong version of the Application for your device. Home+ reserves the right to terminate access to the Services should you be using the Website or Application with an incompatible or unauthorized device.
You may only have one Home+ account, irrespective of the number of devices you are using to access the Services.
By using the Services, you agree that:
- You will only use the Services for your sole, personal use (or for use by an entity which you are duly authorised to represent) and that you will not resell (or attempt to resell) any aspect of the Services to a third party;
- You may not access the Services by any other means than those officially permitted by us;
- You will not authorise others to use your Home+ account. In the case of an entity, only authorised personnel may use the entity’s account;
- You will not assign or otherwise transfer your account to any other person or legal entity;
- You will not, without appropriate authorisation, use (or attempt to use) an account that is subject to any rights of a person other than you;
- You will not use (or attempt to use) the Services for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes;
- You may not submit any violent, nude, racial, discriminatory, unlawful, infringing, hateful, pornographic, sexually offensive or suggestive material, or any other offending information through the Services or direct any unwanted messages, comments, or other harassing communications to any person;
- You will not use (or attempt to use) the Services to cause nuisance, annoyance or inconvenience to any person;
- You will not impair (or attempt to impair) the proper operation of the network;
- You will not do anything which has the potential to harm the Services in any way whatsoever;
- You will not copy or distribute any aspect of the Services or other Home+ Content without written permission from Home+;
- You will keep secure and confidential your account details;
- You will provide us with whatever information and/or proof (including, for example, proof of your identity) which we may reasonably request;
- You are aware that when requesting Services by SMS (if available), standard messaging charges will apply;
- You will not use the Services with an incompatible or unauthorised device; and
- You will comply with all applicable laws while using the Services.
Home+ reserves the right to immediately terminate your access to the Services, without notice, should you fail to comply with any aspect of these User Terms.
PAYMENT
You are responsible for ensuring the timely payment of all fees. To this end, you must either make payment via our Website or Application, or you must provide Home+ with the details of a valid credit card account in order for us to charge such account. In this regard, you expressly authorise Home+ (and/or its Payment Processor/s, as defined below) to charge your account an amount equal to the fees which have accrued in connection with your use of the Services (including any taxes, Service fees, administration fees, cancellation fees, booking fees and late fees, as may be applicable).
The use of the Application and the Website is free of charge. However, Home+ reserves the right to introduce a fee for the use of the Application and/or the Website at any time. If we introduce any such fee, we will inform you accordingly and allow you the opportunity to terminate the Agreement.
We charge an administration fee in respect of each booking made by you for the provision of the Services by a Supplier. We may also charge a cancellation fee for cancelled bookings.
The rates that apply in respect of any Services to be provided by a Supplier can be found on the Website and Application. These may be modified or updated from time to time. It is your responsibility to remain informed about the current rates for the Services.
You are responsible for ensuring the timely payment of all fees. To this end, you must either make payment via our Website or Application, or you must provide Home+ with the details of a valid credit card account in order for us to charge such account. In this regard, you expressly authorise Home+ (and/or its Payment Processor/s, as defined below) to charge your account an amount equal to the fees which have accrued in connection with your use of the Services (including any taxes, Service fees, administration fees, cancellation fees, booking fees and late fees, as may be applicable).
All payments are non-refundable.
You may not withhold or deduct monies from any amounts owing to us or a Supplier.
You warrant and undertake that you will have sufficient freely available funds in your payment account to pay for all fees applicable to the Services which you purchase from the Supplier, as well as all administration fees and other fees payable to us.
If any charge-back claim occurs, it is the responsibility of the User to provide the Supplier with all necessary documentation to resolve the claim.
Where we use a third-party payment processor (the “Payment Processor“) to process payments on our behalf, we will let you know, in which event, in addition to these User Terms, you will also be subject to the terms, conditions and privacy policies of the relevant Payment Processor. Home+ is not responsible for any errors by the Payment Processor.
Home+ will obtain certain transaction details in connection with your use of the Services, which Home+ will use solely in accordance with applicable data protection legislation.
You agree that you are responsible for all charges and costs that you incur in accessing the Services, including but not limited to, data charges, transaction fees and bank charges.
INDEMNIFICATION
By accepting these User Terms and using the Services, you agree to defend, indemnify and hold Home+, its affiliates, its licensors, and each of their officers, directors, other Users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or in connection with:
- your violation or breach of any term of these User Terms or any applicable law or regulation, whether or not referenced herein;
- your violation of any rights of any third party, including Suppliers arranged via the Services, or
- your use or misuse of the Services.
LIABILITY
Any information, recommendations and/or other guidance which may provided to you pursuant to the provision of the Services is for general information purposes only and does not constitute formal advice.
The Services are provided on an “as is”, “as available” and “with all faults” basis and is made available on a good faith basis.
Home+ will use reasonable endeavours to keep the Website and the Application and its contents correct and up to date, but we do not guarantee that the Website and/or Application are free of errors, defects, malware and viruses or that the Website and/or Application are correct, up to date and accurate.
Under no circumstances will we be liable for any harm arising out of your use of the Services, unless directly attributable to our gross negligence or wilful misconduct. This includes (amongst other things) any damages resulting from (i) your use of (or inability to use) the Website or the Application, including damages caused by malware, viruses or any incorrectness or incompleteness of the Information or the Website or Application or (ii) your use of (or the inability to use) electronic means of communication in relation to the Website or the Application, including — but not limited to — damages resulting from failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.
Without prejudice to the foregoing, our aggregate liability will in no event exceed an amount equal to our administration fees in respect of the relevant Services.
The quality of the Services provided by a Supplier is entirely the responsibility of the Supplier who ultimately provides such Services to you. Home+ under no circumstance accepts liability in connection with and/or arising from the Services provided by the Supplier or any acts, actions, behaviour, conduct, and/or negligence on the part of the Supplier. Any complaints about the Services provided by the Supplier should be submitted to Home+ and the Supplier but ultimately, it is the responsibility of the Supplier to remedy.
LICENSE GRANT, RESTRICTIONS AND COPYRIGHT POLICY
Subject to your compliance with these User Terms, Home+ grants you a limited, non-exclusive, non-transferable license:
- to view, download and print any Home+ Content solely for your personal and non-commercial purposes; and
- to view any User Content to which you are permitted access solely for your personal and non-commercial purposes.
You have no right to sublicense the license rights granted in this section.
You may not use, copy, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, reproduce, transmit, stream, broadcast or otherwise exploit the Website, the Application, the Services, or Collective Content, except as expressly permitted in these User Terms. You may not reuse any Collective Content without first obtaining the written consent of Home+. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Home+ or its licensors, except for the licenses and rights expressly granted in these User Terms.
We may, in our sole discretion, permit Users to post, upload, publish, submit or transmit User Content on the Website, Application or through the Services. User Content will be deemed non-confidential and non-proprietary. Home+ shall have a perpetual, non-exclusive, royalty-free, right to use, copy, distribute and disclose to third parties any User Content for any purpose, in any medium and throughout the world (“License Grant“).
You acknowledge that Home+ only acts as a passive conduit for the distribution of the User Content and is not responsible or liable to you or to any third party for the content or accuracy of the User Content. Home+ shall not be continuously monitoring User Content published by you or moderating between Users, nor shall Home+ be under an obligation to do so. Without limiting the foregoing, you acknowledge and agree that any remarks, opinions, comments, suggestions and other information expressed or included in the User Content do not necessarily represent those of Home+.
Any use by you of the User Content is entirely at your own risk. You represent and warrant that any User Content posted or transmitted by you is original to you and does not copy the work of any third party or otherwise infringe any third party intellectual property rights, rights of privacy or personality rights and does not contain any defamatory or disparaging statements. Furthermore, you represent and warrant that you have the capacity to grant the license as stipulated in this paragraph.
You agree to indemnify and keep Home+, its affiliates and licensors indemnified against all costs, expenses, damages, losses and liabilities incurred or suffered by Home+ or its affiliated companies related to any User Content posted or transmitted by you or your other use of the Services.
Home+ reserves the right at its sole discretion to block or remove (in whole or in part) any User Content posted or transmitted by you and which Home+ believes is not in accordance with these User Terms (including materials which infringe or may infringe third party intellectual property rights, rights of privacy or personality rights), or is otherwise unacceptable to Home+.
You agree to promptly notify Home+ in writing of any User Content which breaches these User Terms. You agree to provide to Home+ sufficient information to enable Home+ to investigate whether such User Content breaches these User Terms. Home+ agrees to make good faith efforts to investigate such complaint and shall take such action as Home+ in its sole discretion decides. However, Home+ does not warrant or represent that it will block or remove (in whole or in part) such User Content.
APPLICATION LICENSE
Subject to your compliance with these User Terms, Home+ grants you a limited non-exclusive, non-transferable license to download and install a copy of the Application on a single mobile device that you own or control and to run such copy of the Application solely for your own personal use.
You shall not:
- license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make the Services available to any third party in any way;
- modify or make derivative works based upon the Services;
- create Internet “links” to the Services or “frame” or “mirror” any part of the Services on any other server or wireless or Internet-based device;
- reverse engineer or access the Application or the Website in order to:
- design or build a competitive product or service;
- design or build a product using similar ideas, features, functions or graphics;
- copy any ideas, features, functions or graphics of the Services; or
- launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the Services.
- send spam or otherwise duplicative or unsolicited messages in violation of applicable laws;
- send or store infringing, obscene, threatening, libellous, or otherwise unlawful or tortious material, including material harmful to children or violative of third party privacy rights;
- send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;
- interfere with or disrupt the integrity or performance of the Website, the Application or Service or the data contained therein; or
- attempt to gain unauthorized access to the Website, the Application or Services or its related systems or networks.
Home+ will have the right to investigate and prosecute violations of any of the above to the fullest extent of the law. Home+ may involve and cooperate with law enforcement authorities in prosecuting Users who violate these User Terms. You acknowledge that Home+ has no obligation to monitor your access to or use of the Services, Collective Content or to review or edit any Collective Content, but has the right to do so for the purpose of operating the Website, the Application and Services, to ensure your compliance with these User Terms, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. Home+ reserves the right, at any time and without prior notice, to remove or disable access to any Collective Content that Home+, at its sole discretion, considers to be in violation of these User Terms or otherwise harmful to the Services.
COPYRIGHT POLICY
Home+ respects copyright law and expects its Users to do the same. It is Home+’s policy to terminate in appropriate circumstances Users or other account holders who infringe or are believed to be infringing the rights of copyright holders.
INTELLECTUAL PROPERTY OWNERSHIP
Home+ (and its licensors, where applicable) shall own all right, title and interest, including all related intellectual property rights, in and to the Website, Application and the Services and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to the Website, Application or the Services.
These User Terms do not constitute a sale and do not convey to you any rights of ownership in or related to the Website, the Application or the Services, or any intellectual property rights owned by Home+. Home+’s name, logo, and the product names associated with the Application and Service are trademarks of Home+, its affiliated companies or third parties, and no right or license is granted to use them.
APP STORE SOURCED APPLICATION
With respect to any Application accessed through or downloaded from the Apple App Store (“App Store Sourced Application“), you will use the App Store Sourced Application only:
- on an Apple-branded product that runs iOS (Apple’s proprietary operating system software); and
- as permitted by the “Usage Rules” set forth in the Apple App Store Terms of Service. Home+ reserves all rights in and to the Application not expressly granted to you under these User Terms.
You acknowledge and agree that:
- these User Terms are valid between you and Home+ only, and not Apple, and
- your use of the App Store Sourced Application must comply with the App Store Terms of Service.
You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App Store Sourced Application.
In the event of any failure of the App Store Sourced Application to conform to any applicable warranty, you may notify Apple.
You acknowledge that Apple is not responsible for addressing any claims you have or any claims of any third party relating to the App Store Sourced Application or your possession and use of the App Store Sourced Application, including, but not limited to:
- product liability claims;
- any claim that the App Store Sourced Application fails to conform to any applicable legal or regulatory requirement; and
- claims arising under consumer protection or similar legislation.
You acknowledge that, in the event of any third party claim that the App Store Sourced Application or your possession and use of that App Store Sourced Application infringes that third party’s intellectual property rights, Apple will not responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries relating to your license of the App Store Sourced Application, and that, upon your acceptance of these User Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the rights under these User Terms as related to your license of the App Store Sourced Application against you as a third party beneficiary thereof.
Without limiting any other provisions of these User Terms, you must comply with all applicable third party terms of agreement when using the App Store Sourced Application.
THIRD PARTY INTERACTIONS
Pursuant to your use of the Services, links to websites that are owned and controlled by third parties may be provided from time to time in order to enter into correspondence with, purchase goods or services from, participate in promotions of third parties. These links take you off the Website, the Application and/or the Services and are beyond Home+’s control.
During use of the Services, you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of third party service providers, advertisers or sponsors showing their goods and/or services through a link on the Website or through the Application or Services. These links take you off the Website, the Application and the Services and are beyond Home+’s control. The websites you can link to have their own separate terms and conditions as well as a privacy policy. Home+ is not responsible and cannot be held liable for the content and activities of these websites. You therefore visit or access these websites entirely at your own risk.
Please note that these other websites may send their own cookies to users, collect data or solicit personal information, and you are therefore advised to check the terms of use or privacy policies on those websites prior to using them.
TERM AND TERMINATION OF THE AGREEMENT
The Agreement endures for an indefinite period.
You are entitled to terminate the Agreement at any time by deleting your User account, provided that you will still be liable for all amounts which accrued prior to such termination. Please contact us at support@homeplus.africa in order to delete your account.
Home+ is entitled to terminate the Agreement at any time:
- if you violate or breach any term of these User Terms, or
- in the opinion of Home+, you misuse the Services.
- for any reason or cause and in its sole discretion.
Home+ is not obliged to give notice of the termination of the Agreement in advance.
INVALIDITY OF ONE OR MORE PROVISIONS
The invalidity of any term of these User Terms shall not affect the validity of the other provisions of these User Terms.
If and to the extent that any provision of these User Terms is invalid, or is unacceptable in the given circumstances according to the criteria of reasonableness and fairness, a provision shall apply between the parties instead that is acceptable considering all the circumstances and which corresponds with the provisions of the void part as much as possible, taking into account the content and the purpose of these User Terms.
MODIFICATION OF THE SERVICE AND USER TERMS
Home+ reserves the right, in its sole discretion, to modify or replace any of these User Terms, or change, suspend, or discontinue the Services, the Website or the Application (including without limitation, the availability of any feature, database, or content) at any time by written notice. Home+ may also impose limits on certain features and Services or restrict your access to parts or all of the Services without notice or liability.
NOTICE
Home+ may give notice by means of a general notice on the Website or the Application, or by electronic mail to your email address on record in Home+’s account information, or by written communication sent by regular mail to your address on record in Home+’s account information.
ASSIGNMENT
You may not assign your rights under these User Terms without prior written approval of Home+.
PRIVACY AND COOKIE NOTICE
Home+ collects and processes the personal data of the visitors of the Website and Users of the Application according to applicable data protection legislation.
We respect your privacy and will take all reasonable measures to protect it, as more fully detailed in our Privacy Policy, which is incorporated by reference and can be found HERE.
ELECTRICITY PURCHASES
The purchase of electricity via this Site is subject to any credit limitations or payment ceilings imposed by the User’s bank, and by the limits of the User’s electricity meter. Due to the consumable nature of electricity, should the User purchase electricity in error or in excess of the User’s requirements, Home+ shall be under no obligation to refund the User or to reverse the transaction. Accordingly no cooling-off period as contemplated by section 44 of the Electronic Communications and Transactions Act 25 of 2002 shall apply. The price payable for a unit of electricity shall be as set by the Local Authority’s Administration.
Payment for the electricity purchased via this Site shall be effected by the User to Home+ by way of a credit card transaction using a valid credit card which is accepted by Home+. Note that to protect its own and the interests of Users, Home+ scrutinizes all transactions very carefully to prevent attempted fraud. Accordingly a transaction may be refused if Home+ is not satisfied with its legitimacy.
Although every effort is made to ensure that the User receives the purchased electricity immediately, Home+ in no way warrants that the service will be completely uninterrupted and error free and that accordingly there may be a delay in the delivery of the electricity to the User.
EMERGENCY SERVICES / SECURE RESPONSE
By using the Emergency Services / Secure Response, the user hereby accepts the service providers (Rapid Response) terms and conditions, which conditions the user acknowledges having read and understood and agrees will be binding on the user. The terms and conditions specific to this services are available HERE for your convenience.
REWARDS
The competition has no fixed time period and is available from 1st April 2022. A customer is required to have a verified Home+ account before they can play.
Customer is required to have a minimum of R500 of electricity credit on their account before they can play.
For each R500 a customer tops up in electricity credits, they are entitled to 1 play of the game.
1 play = 1 coin turn
Home+ Rewards Game prize amounts as follows:
Total = 19 coins
We are using random choices built-in python function. choices() algorithm uses floating point arithmetic to randomly assign the values of R50, R20 and R10 to each tile in the board game. Each coin is randomly assigned a value of R50, R20, R10 with the probability of 5% for R50, 21% for R20, 74% for R10
A customer is limited to a total of 19 plays
A customer cannot redeem their rewards until they have a total of minimum R20.
“Home+ Rewards” means pre-paid credits that a customer wins through playing the Home+ Rewards Game, and can be used to purchase electricity on the Home+ App. Rewards cannot be exchanged for any other prizes or redeemed in cash.
Home+ may suspend access to or disable your Home+ Rewards game if it has reason to believe that it has been used in or has been associated with any fraud or attempted fraud
Home+ Rewards Game will collect data about you and your purchases using Rewards Game. We take your privacy seriously and data collected will be used only in accordance with the Privacy Policy. You can see our full Privacy Policy HERE
APPLICABLE LAW AND DISPUTE RESOLUTION
These User Terms are subject to the laws of South Africa. Any dispute or claim arising out of or relating to these User Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services (collectively, “Disputes”) will be settled in the following manner.
- Any dispute arising from or in connection with these User Terms shall (with the exception of urgent relief from a court of competent jurisdiction) in the first instance be referred to the respective Chief Executive officers of the parties, failing whom, their respective equivalents or nominees (“CEO’s”). Should the CEO’s be unable to resolve the dispute within 7 days after the referral of the dispute to them, the dispute shall, at the request of any party to the dispute, be dealt with as provided below in clause 2.
- Any dispute arising from or in connection with these User Terms, which has not been resolved pursuant to clause 1 above, shall be finally resolved in accordance with the rules of the Arbitration Foundation of Southern Africa (“AFSA”) by an arbitrator agreed to between the parties and failing such agreement within three days of a request therefore by a party, an arbitrator appointed by AFSA.
- The parties irrevocably agree with each other and undertake that any award, decision or finding which may be made by the arbitrator, shall be final and binding upon them, shall be carried into effect and / or may be made an order of court on the application of any party to the arbitration proceedings.
- The seat of the Arbitration shall be in Cape Town
HOME+ REFERRAL PROGRAM (ALSO REFERRED TO AS “REFER A FRIEND”)
- The Referral Program is only available to existing users of the Plus Ecosystem Ventures (Pty) Ltd (t/a Home+) who have registered with a valid email address and phone number (a “Referer”).
- To participate in the Referral Program, users must provide the referral code to their friends, family, colleagues or acquaintances (a “Referred Party”) and ask them to type in the code into the referral code field upon signing up for the app.
- A voucher will be provided to the Referred Party for use on their first repair or maintenance job through Home+.
- A voucher will be awarded to the Referrer upon completion of the referred party’s first repair or maintenance job through the Home+ app (the “Referral Bonus”).
- Referral Bonuses and vouchers are subject to change and may be modified or discontinued at any time without notice.
- The Referral Code can only be used once per Referred Party.
- Referral Bonuses and vouchers are not transferable and have no cash value.
- The Referral Program will become void if it becomes prohibited by law.
- Employees of the company and their immediate family members are not eligible to participate in the Referral Program.
- Home+ reserves the right to terminate or suspend any user’s participation in the Referral Program at any time if it suspects any fraud or misconduct.
- Home+ reserves the right to terminate the Referral Program at any time and for any reason.
- By participating in the Referral Program, users agree to these terms and conditions and the company’s privacy policy.
